Dobbin AI Acceptable Use Policy

If you (or the entity you represent) have signed a separate Common Paper “Cover Page” (including an Order Form) with Provider for the Product (the “Signed Agreement”), then this Acceptable Use Policy (this “AUP”) applies only if the Signed Agreement (or any incorporated Framework Terms) expressly incorporates this AUP (including by reference to https://dobbin.ai/aup). If incorporated, this AUP forms part of the Signed Agreement. If you have not signed a Signed Agreement, then this AUP is incorporated into and forms part of the online Terms of Service applicable to the Product. In each case, if there is any conflict between this AUP and the applicable agreement governing your use of the Product, the applicable governing agreement controls to the extent of the conflict.
Capitalized terms used but not defined in this AUP have the meanings given in the agreement that governs Customer’s use of the Product (including the Common Paper Cloud Service Agreement Standard Terms Version 2.1 as modified by Provider https://dobbin.ai/CSA, as incorporated into that agreement).
(a) Compliance. Customer and Users will use the Product only in compliance with this acceptable use policy (“Acceptable Use Policy” or “AUP”) and Applicable Laws.
(b) Prohibited Conduct. Customer will not, and will not permit any User or third party to:
(i) use the Product to violate Applicable Laws or any third-party rights, including intellectual property, privacy, or publicity rights;
(ii) use the Product to develop, train, test, benchmark, or improve (directly or indirectly) any competing product or service, including any competing artificial intelligence or machine learning models, except as expressly authorized in writing by Provider;
(iii) reverse engineer, decompile, disassemble, translate, or otherwise attempt to discover the source code, model weights, model architecture, or underlying ideas or algorithms of the Product, except to the extent expressly permitted by Applicable Laws that cannot be waived;
(iv) interfere with, disrupt, compromise, or bypass any security, access controls, rate limits, usage limits, or other technical restrictions of the Product, including by probing, scanning, or testing the vulnerability of any system or network used in connection with the Product;
(v) introduce into the Product any malware, bot, worm, Trojan horse, time bomb, ransomware, spyware, or other harmful code or materials;
(vi) use the Product to generate, distribute, or facilitate phishing, fraud, deceptive marketing, spamming, or other misleading or abusive practices;
(vii) submit or transmit Prohibited Data to the Product;
(viii) use the Product for any High Risk Activity;
(ix) share, sell, transfer, or make available to any third party any API key, access credential, or account designated for Customer’s use, or allow any individual who is not an authorized User to access or use the Product through Customer’s account;
(x) use bots, scripts, spiders, scrapers, or other automated means to access the Product in a manner that (A) materially exceeds reasonable request volume, (B) bypasses any technical limitations, rate limits, or access controls, or (C) imposes an unreasonable or disproportionately large load on the Product; or
(xi) use the Product to generate, distribute, or facilitate content that is unlawful, defamatory, or that a reasonable person would consider threatening, harassing, or abusive, or that infringes or misappropriates any third-party intellectual property, privacy, or publicity rights.
(c) Enforcement. Enforcement. If Provider reasonably believes Customer’s or any User’s use of the Product violates this AUP, Provider may suspend or restrict access to the Product, in whole or in part, to prevent harm, protect the Product or other customers, preserve security or availability, or comply with Applicable Laws. Where practicable, Provider will provide notice and a reasonable opportunity to cure. Notwithstanding the foregoing, Provider may immediately suspend access without prior notice if Provider reasonably determines that the violation (i) poses a security risk, (ii) could result in liability or material harm to Provider or any third party, or (iii) could materially degrade the Product’s availability for other customers.
